By creating an account or using darkdown, you agree to these Terms. If you disagree with any part of these Terms, you may not use our Service.

2. Description of Service

darkdown is a web-based application that allows users to:

• Create and edit markdown notes
• Share notes publicly or keep them private
• Organize notes with folders
• Access notes from any device
• Ask AI questions about your notes using the Ask AI feature

The Service is provided with both free and paid tiers, and may be modified, suspended, or discontinued at any time.

• Encryption at rest (AES-256) and in transit (HTTPS/TLS)
• Row Level Security to ensure data isolation between users

3. User Accounts

4. User Content

4.1 Your Ownership

You retain all rights to the content you create and post on darkdown ("User Content").

4.2 License to darkdown

By posting User Content, you grant darkdown a worldwide, non-exclusive, royalty-free license to:

• Store, display, and distribute your content through the Service
• Make backups to prevent data loss
• Share public notes as you've designated

This license exists only to provide the Service and ends when you delete your content or account.

4.3 Public Content

When you make notes public:

• They can be viewed by anyone with the link
• They may appear in search results
• Other users may share links to your public notes

4.4 Content Standards

You agree not to post content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains malware or harmful code
• Is harassing, defamatory, or threatening
• Is spam or commercial solicitation
• Impersonates others
• Contains private information of others

4.5 AI-Generated Content

When using the Ask AI feature, you understand that:

• AI responses are generated based on your notes and may not always be accurate
• You are responsible for verifying any AI-generated information
• AI responses are not professional advice (legal, medical, financial, etc.)
• You retain ownership of your queries and the AI responses you receive

5. Prohibited Uses

You may not:

• Use the Service for illegal purposes
• Attempt to hack, disrupt, or overload our systems
• Scrape or harvest data without permission
• Create multiple accounts to evade restrictions
• Use automated systems to access the Service
• Resell or commercialize the Service

6. Privacy

Your use of darkdown is subject to our Privacy Policy. By using the Service, you consent to our collection and use of information as detailed in the Privacy Policy.

6.1 Privacy and Data Use

By using darkdown, you understand and agree that:

• We use third-party services solely for functionality, not marketing
• Analytics help us improve the service but don't track personal data
• Error monitoring helps maintain reliability
• You consent to necessary data processing by signing in
• We never sell or share your data for advertising
• You can delete your account and all data anytime

7. Third-Party Services

darkdown uses these third-party services exclusively for functionality:

• Supabase - For backend functionality, authentication, and data storage
• OpenAI - For AI-powered features in Ask AI. When you use Ask AI, your queries and relevant note context are processed by OpenAI's API
• PostHog - For understanding how users interact with darkdown to improve the service
• Sentry - For monitoring errors and ensuring darkdown works reliably
• Stripe - For processing payments if you choose to upgrade to Pro
• Deepgram - For converting speech to text in voice notes

No Advertising: We do not use any advertising networks, marketing platforms, or tracking pixels. Third-party services are used solely to provide and improve darkdown's functionality.

Your use of the Service may be subject to additional third-party terms.

8. Disclaimers

8.1 "As Is" Service

darkdown is provided "as is" and "as available" without warranties of any kind, either express or implied.

8.2 No Guarantee

We do not guarantee that:

• The Service will be uninterrupted or error-free
• Content will be accurate or reliable
• Data will never be lost
• The Service will meet your requirements

9. Limitation of Liability

To the fullest extent permitted by law, darkdown shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of profits, data, or goodwill
• Service interruptions or data loss
• Content posted by users

Our total liability shall not exceed $100 or the amount you've paid us in the past 12 months, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless darkdown from any claims, damages, or expenses arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of others

11. Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by darkdown and protected by intellectual property laws.
